
These general terms and conditions apply by priority to all services provided or to be provided by Vespatoerist BV (hereinafter: the Letter), including the services performed by its directors, partners, employees or by third parties with whom it cooperates or for which it is liable. They shall apply to all domestic and foreign legal relationships established in this context between the Landlord and its customers or other third parties.
Deviations from these general conditions are only valid if they have been expressly accepted in advance and in writing by the lessor. The application of general or special conditions of the customer, as well as of any conditions to which documents of the customer would refer, is expressly excluded, except with the written agreement of the Landlord.
By requesting or purchasing services from the Host, the Customer automatically accepts these general terms and conditions, both for current and future services. This acceptance also applies to any changes to the general terms and conditions, of which the customer will be appropriately notified.
If the customer is a foreign company, regardless of whether it is located inside or outside the European Union, it expressly and irrevocably accepts, by the conclusion of the contract, that these general terms and conditions shall apply in priority to the cooperation between the parties. The foreign customer acknowledges that it cannot invoke commercial customs, rules or habits of its own legal system. All aspects of the cooperation between the parties shall be governed exclusively by Belgian law.
The Landlord offers the following services, among others, to its customers:
All quotations, price proposals and offers of the Landlord are without obligation and bind the Landlord only after express acceptance by the Customer.
The agreement is established at the moment when the customer agrees to the rental agreement or offer prepared by the Landlord, either orally or in writing, including electronic communication. From that moment, the agreed price is deemed to be known and expressly accepted by the customer.
The customer, also driver, expressly declares that he/she has the required driving skill, ability and suitability to drive or use the rented vehicle or property, and that he/she complies with all legal and regulatory conditions applicable thereto.
A renter and/or the driver of the rented vehicle must have the legally required license for the type of vehicle rented, provisional licenses are not sufficient.
Children are allowed as rear seat passengers from the age of 5. Up to the age of 8 years and when the children cannot support themselves on the footplate, the use of a child harness is mandatory.
Vespa 50cc: It is mandatory to wear a helmet with the correct approval (European standard ECE-R 22.05), this also applies to the passenger. It is not mandatory to wear protective clothing but it is recommended.
Vespa 125cc: It is mandatory to wear a helmet with the correct approval (European standard ECE-R 22.05), this also applies to the passenger. Protective clothing (jacket with long sleeves, long pants, shoes above the ankles, gloves) is mandatory for both driver and passenger.
APE Calessino: Wearing a helmet and protective clothing is not mandatory when using the belts.
Fiat 500: Wearing seat belts is mandatory only in the front row.
Mazda MX-5: Wearing seat belts is mandatory.
Vespa 50cc: All Vespas 50cc fall under the category "Moped Class B (Maximum Speed 45 km/h). On roads where the maximum speed exceeds 50 km/h, it is mandatory to use the bike lane. If there is no bike lane, drive on the far right. On roads where the maximum speed is 50 km/h or lower you may choose whether to use the bike path or not, also pay attention to Prohibition signs (A, B or P) here. You may not drive on mixed pedestrian and bicycle paths, note that this includes most of the bicycle route network.
Vespa 125cc & APE Calessino: A Vespa 125cc or APE Calessino falls under the category of "Motorcycle. Drivers, like motorists, are required to use the roadway. It is strictly forbidden to use the bike lane. Unlike motorists, however, they are allowed to drive on the bus lane and on the "special crossable bed", if the symbol of the motorcycle is displayed on the relevant traffic signs. That symbol may also be painted on the bus lane or bed itself.
Fiat 500/Mazda MX-5: Our Fiat 500 and Mazda MX-5 fall under the category of "car" and the relevant legislation.
The total number of vehicles in the group determines whether a Group is assumed or not. As of 10 vehicles, you function as a Group and guidance is required. Depending on the size of the group, a number of escorts or road captains are required:
Escorts may be members of the group or provided by the Host at the current rate. Accompanyers must wear a retro-reflective safety vest with the word "Road Captain" on the back and in black letters, be at least 25 years old and have a traffic sign C3. Escorts are responsible for the proper conduct of the tour and at intersections where traffic is not regulated by traffic lights, at least one of the road captains may stop traffic in the cross roads, in the manner provided in Article 41.3.2. while the group is crossing.
Unless otherwise and agreed in writing, the rental period is 4, 5 or 9h and the pickup and return location is determined as Rutterweg 85, 3700 Tongeren. Departure for the morning ride (4h) and day ride (9h) is possible as of 09h30 and the vehicle must be returned for the morning ride at the latest at 13h30, for the day ride the vehicle must be returned at the latest at 18h30. For the afternoon ride (5h) departure is possible from 13h30 and the vehicle has to be returned before 18h30.
For late returns, the rental company reserves the right to charge the full daily rate for a morning or afternoon ride and an additional rental charge of €25 per hour started late for a day ride.
The earlier return of the rented property does not entitle to full or partial refund of the rent as agreed on the rental contract.
The handling of other rental periods is possible only when agreed in writing.
When the weather conditions are unfavorable to start the rental or for other reasons, the renter can cancel or rebook to another date free of charge by contacting us by email or phone at least 1 hour before the start of the rental period. If the renter is not present on the day of appointment without prior notice, the reservation will be cancelled and any deposit will be retained as a cancellation fee. If food is included in the reservation, the renter must cancel 4 working days before the reservation date, if this does not happen, the cost for the food is still due.
If the lessor considers the driver not sufficiently competent to safely drive the rented property, the lessor reserves the right to cancel the ride for this driver. Rentals already paid will be fully refunded in this case.
The currently applied rent includes the following elements:
Use of chosen vehicle, use of helmets, use GPS including routes, fuel, assistance, Good Weather Guarantee, Civil Liability Insurance and Legal Aid, drink on arrival, explanation on how to use the vehicle and set up GPS, VAT.
The currently applied rent does NOT include the following elements:
Cost of repairing the vehicle due to poor use by the renter, cost of repairing the vehicle due to improper use, personal property insurance.
The full rental price, including any deposit and/or additional insurance must be paid before departure. If the renter requires an invoice, this must be indicated before departure and a deposit of minimum 25% of the total rental amount must be paid before departure. The full invoice must be paid no later than 14 days from date of invoice (invoice date equals trip date).
The vehicles are insured only in BA (Civil Liability) and legal assistance. Damage to own vehicle is not insured, nor disappearance/theft/total loss of the rented vehicle or personal belongings. The damage to own vehicle can be additionally insured according to the insurance conditions in this document. The renter expressly declares to have taken note of the insurance conditions and undertakes to comply strictly with them. The insurance policy can be consulted at the request of the renter. In case one or more risks or guarantees covered by the insurance policy would be suspended or cancelled due to the renter's behavior, the renter commits himself to indemnify the lessor for all damages or costs that could arise for the lessor as a result of this. In case of damage or injury to third parties, the resulting costs may be recovered from the lessor's third party liability insurance. An excess of €250 will be charged to the renter in this case. In case of own injury and resulting damages and costs, these cannot be recovered from the Civil Liability Insurance of the lessor.
When renting a vehicle or multiple vehicles, the renter provides a deposit to the rental company according to the number of vehicles in the rental. (1-3 vehicles = €300, 4-6 vehicles = €500, 7-9 vehicles = €800, 10 vehicles or more = €1000). All damages to the rented vehicles are the responsibility of the renter and will be deducted from the deposit. If the deposit paid does not cover the damage incurred, an additional amount will be charged. The total amount of the damage will be determined by the new price of the parts to be replaced, possibly increased by the cost of repairs carried out by third parties.
If desired, the renter may purchase additional insurance for damage to own vehicle. This insurance covers damage to own vehicle but does not intervene in case of disappearance/theft/total loss of the rented property or personal belongings. If the renter opts for additional insurance for damage to own vehicle, the renter does not have to pay a deposit and an excess is applied. The total amount of the damage (new price of parts to be replaced, plus the cost of repairs performed by third parties) will be deducted from the deductible. The deductible is the maximum amount for which the renter is liable. The table below defines the insurance prices and deductibles to be used. This insurance is taken out per vehicle and is mentioned on the rental contract.

The lessor agrees to deliver the rented vehicles to the lessee in a good state of repair, on the agreed date and rental location. The lessor undertakes that the vehicle meets all technical qualifications peculiar to the vehicle.
The renter agrees to use and maintain the rented vehicle with due diligence and to return it at the end of the agreement in the same condition in which it was received. It is forbidden to use the vehicle for competitions, stunts, off-road activities or any use that does not correspond to the normal and foreseen use.
It is strictly forbidden for the renter and/or driver to drive the rented vehicle under the influence of alcohol, drugs, medicines or other substances that may affect driving ability, in accordance with applicable laws.
If the lessor determines or reasonably suspects that the hirer or driver is in a condition that compromises safety, the lessor reserves the right to:
In such case, the tenant shall not be entitled to any refund of the rent paid, without prejudice to the landlord's right to recover any damages, costs or penalties in full from the tenant.
Damage to the vehicle, injuries to third parties or other consequences resulting from the use of the vehicle under the influence of alcohol, drugs or other narcotic or mind-altering substances are the sole responsibility of the renter and are not covered by any insurance of the rental company.
The lessor cannot be held liable for failure to perform the agreement in whole or in part if this is due to force majeure.
Force majeure shall mean any event independent of the lessor's will that makes the performance of the agreement impossible in whole or in part, including, but not limited to:
accidents, mechanical failure, fire, theft, vandalism, extreme weather conditions, pandemics, strikes, government measures, traffic restrictions, technical failures or other unforeseen circumstances.

In such cases, no compensation may be claimed from the lessor. Amounts already paid may, depending on the circumstances, be refunded or offset in the form of a credit voucher or a new reservation at a later date, without the lessor being liable for any additional compensation.
For violations of any of the above guidelines or any legislation, the landlord cannot be held liable for the possible costs, fines or consequences. Any resulting costs, fines or consequences are entirely the responsibility of the renter.
Landlord undertakes to protect customers' data and not to resell it to or share it with third parties, in accordance with applicable GDPR legislation.
Any complaint must be made in writing to the landlord's address. Complaints must be reported in writing as soon as possible and at the latest within eight days after the ride, unless mandatory consumer law provides for a longer period. All disputes to which this contract might give rise are subject to the exclusive jurisdiction of the courts of the landlord's registered office. It is the intention of the parties that this contract is drawn up, interpreted and executed in accordance with the laws of Belgian domestic law.


A delicious barbecue before or after the ride, no problem! We work with a local partner and offer you 3 pieces of meat per person. We provide a deluxe salad bar, sauces and bread.

Delicious post-ride BBQs with no worries. We provide fresh ingredients (3 cuts of meat/pp, deluxe salad bar, bread and sauces) and the supplies (BBQ, charcoal, utensils, plates and cutlery). You just need to designate a volunteer to bake. We will do the dishes and beverage service!
